Positive action

Definition

This term refers to measures aimed at eliminating the obstacles that prevent equal opportunities and substantive equality between male and female workers from being achieved.

Protection

Positive action must be guaranteed in both the public and private sectors. This is not only enshrined in the Italian Constitution, but also in Legislative Decree No. 198/2006. They are also provided for in regulations that are not strictly labour law-related (see the example).

Example?

The so-called "PINK QUOTAS" - introduced in Italy by Law No. 120/2011, Presidential Decree No. 251/2012, Article 11 of Legislative Decree No. 175/2016, and Article 1, paragraphs 302–305, of Law No. 160/2019 - require gender balance in the composition of the administrative and control bodies of listed companies and unlisted companies with public participation.
